Support to undocumented migrants organizations present an argument in three points to impose the idea of the need to regularize massively "clandestine". It can suggest control its migration flows, which is the essence of a sovereign State to ensure integration of the population of foreign origin.
The Republic was severe against the "illegal". It remains no less true that each deportation is a personal human drama. It is therefore for the Republic to act in respect of the dignity of the human person and the rule of law. The administrative judge is involved in the forty-eight hours after the prefectoral decision to escort to the border. It controls the regularity of renewed measures. It checks as if the alien who is subject to an order of escort to the border is not devoid of family ties and has no fear of personal threats in his country of origin. It looks as if the deportation is not disproportionate in character. Any judgment is case by case. In addition, if the "clandestine" found soul mate during the period where it was in an irregular situation, may upon his return to his country of origin start a procedure of marriage and a family reunification procedure. Finally, if the children of a family in an irregular situation following their parents, they are educated in their country of origin, which usually has an education system which is not, a priori, less satisfactory than in France.
If there is any doubt on the legality of an order of escort to the border, the judge rescinds the order. There is a balance between protection of borders and respect for human dignity.
By definition, a circular is not a law or a decree. It provides guidance on the implementation of legislative and regulatory device and has no mandatory. "sarkozy" circular thus encourages the prefects leniency measures, but it is up to each prefect to decide the case by case basis. The regularization of the situation of the families of illegal immigrants is not a right. It is just the Act of a benevolent Republic.
